Since the new regulations came in, artists and small arts organisations have wanted to know how they will work in practice. Although this guidance from solicitor Nicholas Sharp of Swan Turton is aimed predominantly at organisations, it is relevant for any individual artist who undertakes employed or freelance work.
Most arts organisations know that the new regulations governing age discrimination came into force on 1 October 2006. However, what few know is the practical action they should take to comply. Set out below is an overview of the new law followed by a set of action points for arts employers. It is not just employees that are covered by the Age Regulations (The Employment Equality (Age) Regulations 2006): the new law also makes it unlawful for employers to discriminate against office holders (eg company directors and company secretaries), self-employed people, contract workers, job applicants, former employees and students!
